Terms of service.

  1. In the event of CANCELLATION by the LESSOR (B.V.) due to force majeure or other strictly personal, unforeseeable urgent reasons (e.g., health problems), the LESSOR shall immediately notify the RENTER and propose, where possible, an alternative for the Clients that does not change the means of transportation used to reach the boarding (and to depart at disembarkation), or the renter may choose to be refunded the amount paid.

  2. The tour program may vary at the discretion of the skipper based on weather conditions or other navigation or mooring needs. B.V. shall not be held responsible for any program changes, stops, loss of time, and/or interruptions resulting from initiatives or decisions taken by the skipper to ensure the safety of navigation, particularly in unfavorable weather conditions.

  3. Should the planned embarkation and disembarkation ports become unreachable or impractical due to factors beyond the skipper’s control (for example, unfavorable weather conditions), the skipper may decide on more appropriate alternatives and will communicate them in time to the embarked Guests. No compensation or damages can be claimed for such unforeseen events and consequent inconveniences.

  4. B.V. commits to providing the Guests with a vessel in perfect conditions of cleanliness and efficiency, compliant with current regulations, and complete with all the safety equipment required for the type of navigation that will be carried out.

  5. B.V. declares that it has subscribed to the mandatory insurance.

  6. The Guest embarks with full awareness of the risks and dangers that a sailing cruise may entail. In case of injury not resulting from the responsibility or fault of the skipper, the latter cannot be held liable or asked for compensation neither by the skipper nor by B.V.. A personal accident insurance policy is recommended.

  7. The Guest is committed to informing the skipper before boarding, in a strictly personal manner, of any health problems, allergies to medications or foods, or other specific personal needs.

  8. Should the Guest be unable to swim or have other personal impediments, they commit to informing the skipper and to accepting any precaution that the skipper will decide to implement for protection.

  9. It is within the skipper’s authority, for the protection of the cruisers and the safety of the journey, to disembark those who behave improperly, not in accordance with the orderly conduct of the tour or peaceful and disciplined coexistence, cause damage or harassment to other Guests or, in any way, endanger the safety and tranquility.

  10. Each participant is the exclusive custodian of their own objects and personal effects and is personally responsible in case of theft, loss, or damage. They are also responsible for damages caused to the vessel by malicious, negligent, or contrary behaviors to the provisions and instructions given by the skipper.

  11. For anything not regulated by this document, reference is made to the applicable Italian Laws.

  12. For any and all disputes arising from this contract, the exclusive jurisdiction shall be the Court of Como.
